EnableUs - Terms and Conditions

These Terms and Conditions apply to all services supplied by Enable Us Pty Ltd (ACN 667 451 014). By placing an order, you confirm that you have read, understood, and agree to these Terms in full without exception.

1. Scope of Services

1.1 EnableUs provides customised NDIS compliance documentation and general guidance to assist you with your NDIS provider registration.

1.2 Services may include:

– Preparation of tailored compliance documentation.

– General guidance on registration steps.

– Support to help you prepare for audit in line with your purchased package.

1.3 EnableUs does not operate your business, manage your staff, or ensure your suitability to become an NDIS provider. You remain solely responsible for meeting all eligibility and regulatory requirements.

1.4 Timeframes for delivery, including the usual 24 hour turnaround, are estimates only and may vary. No guarantee is given regarding timeframes.

1.5 EnableUs does not guarantee any regulatory, operational, or business outcome.

2. Client Responsibilities

2.1 You must provide full, accurate, and timely information to EnableUs. EnableUs is not liable for any result caused by incomplete, incorrect, or delayed information.

2.2 You confirm that you meet all mandatory NDIS eligibility requirements, including but not limited to insurances, worker checks, qualifications, key personnel standards, and suitability requirements.

2.3 You are responsible for applying, lodging, supplying, attending, responding to, and participating in all NDIS and audit processes.

2.4 You must complete your own NDIS self assessment answers. EnableUs will not write your answers for you under any circumstances. EnableUs may provide feedback only if included in your service package.

2.5 You must follow all EnableUs instructions, guidance, and information provided to you. Failure to do so may impact your results and void any entitlement under the Audit Guarantee.

3. Independent Delivery of Services

3.1 EnableUs may deliver services using its employees, contractors, or external specialists. EnableUs determines all approaches, processes, and methods.

3.2 EnableUs prepares documentation strictly aligned with the NDIS Practice Standards. EnableUs is not required to prepare additional documents, operational tools, or any materials outside the purchased service.

3.3 EnableUs may suspend or delay services at its discretion if you fail to provide required information or cooperate.

4. Payment and No Chargebacks

4.1 Payment must be made in full before work commences.

4.2 Audit fees, operational costs, insurances, checks, and any external costs required for NDIS registration are separate and paid by you.

4.3 You agree not to lodge any chargeback, payment dispute, or reversal through your bank, card provider, or payment platform for any reason. You acknowledge that this clause forms a condition of purchasing EnableUs services.

4.4 Any attempted chargeback or payment dispute will constitute a material breach of these Terms.

5. Strict No Refund Policy

5.1 All services provided by EnableUs are strictly non refundable under all circumstances.

5.2 This includes but is not limited to:

– Change of mind

– Incorrect information provided by you

– Delays caused by you or external parties

– Business or personal circumstances

– Ineligibility to become an NDIS provider

– Regulatory decisions outside EnableUs control

– Failure to follow EnableUs guidance

5.3 No refund will be issued unless EnableUs determines, at its sole and unfettered discretion, that your audit failure was directly and exclusively caused by documentation prepared by EnableUs.

5.4 No other refunds, credits, or financial remedies are available.

6. Audit Guarantee

6.1 The Audit Guarantee applies only to the specific inclusions listed in the purchased service offering.

6.2 The Guarantee ensures your documentation will meet the compliance requirements of an NDIS approved quality auditor.

6.3 The Guarantee does not apply to:

– Failures caused by your performance or knowledge during the audit

– Ineligible or unsuitable key personnel

– Incorrect, incomplete, or late information provided by you

– Operational failures in your business

– Issues relating to AHPRA, criminal history, worker screening, or regulatory suitability

– Any matter outside EnableUs control

6.4 If you fail your audit, EnableUs will conduct a review. EnableUs has absolute discretion to determine the cause of failure and whether the Guarantee applies.

6.5 If EnableUs determines the failure is not caused by our documentation, no refund or remedy applies.

6.6 Any refund provided is at EnableUs absolute discretion and may be refused for any reason.

6.7 The Guarantee does not include audit fees or any external costs.

7. Intellectual Property and Use of Materials

7.1 All documentation provided remains the intellectual property of EnableUs.

7.2 A licence is granted for personal use within your business only.

7.3 Redistribution, resale, copying, sharing, or repurposing of EnableUs materials is strictly prohibited.

7.4 EnableUs reserves the right to withdraw access to materials if unauthorised use is discovered.

8. Limitations of Liability

8.1 EnableUs is not liable for any indirect, consequential, or economic loss, including loss of opportunity, revenue, or reputation.

8.2 EnableUs total aggregate liability for any claim is limited to the amount paid for your order.

8.3 You acknowledge that EnableUs does not guarantee:

– Audit approval

– Registration approval

– Business success

– Eligibility outcomes

– Any regulatory decision

8.4 EnableUs is not responsible for any actions taken by auditors, NDIS representatives, regulators, or external parties.

9. Reliance and No Warranties

9.1 You acknowledge that you have not relied on any marketing statements, sales statements, representations, or promises outside these Terms.

9.2 No warranties, expressed or implied, exist outside what is explicitly stated here.

10. No Employment or Partnership

10.1 Nothing in these Terms creates a partnership, employment, or agency relationship.

11. Termination and Suspension

11.1 EnableUs may suspend or terminate services if you fail to provide required information, engage in misconduct, fail to cooperate, or breach these Terms.

11.2 Suspension does not entitle you to any refund or credit.

12. General Provisions

12.1 These Terms constitute the entire agreement and override any prior understanding or communication.

12.2 If any clause is invalid or unenforceable, the remaining clauses continue in full effect.

12.3 Clauses relating to payment, intellectual property, refunds, liability, and governing law survive completion of services.

12.4 EnableUs may update these Terms from time to time. The version in effect at the time of purchase applies to your order.

13. Governing Law

13.1 These Terms are governed by the laws of New South Wales, Australia.

13.2 You agree to submit exclusively to the jurisdiction of the courts of New South Wales.
